What is a Land Register extract?

A land register extract collects information about a property. There you can see the size of the property is and how it is used. Contents of the Land Register

The Austrian land register is a public directory that collects information about real estate. It is run by the Austrian district courts. Anyone can view the land register online by paying court fees. The inspection is also known as a “land register extract”.
The land register consists of a journal and a collection of documents.

Main register

The general ledger is presented in the so-called land register extract. One property is treated per land register extract. Each property is assigned a register number (EZ). A property can consist of several pieces of land. Also each property is assigned a property number (GST-NR).

Document collection

In the collection of documents, contracts assigned to the property, such as purchase contracts, donation contracts, and documents such as lien documents, deeds of responsibility, can be viewed.

Catastral muncipality (KG)
A political muncipality can consist of several cadastral communities. In the case of smaller muncipalities , it is often the case that they are not further subdivided and the scope of the cadastral muncipality corresponds to that of the municipality. Each cadastral muncipality is assigned a five-digit cadastral muncipality number (e.g. 01660 for Kagran). Here you can find all cadastral muncipality numbers.
Einlagezahl (EZ)
Each land register body is assigned exactly one register number, whereby one register number can include several properties. A property can therefore be clearly identified via the cadastral muncipality and a register number.
Last change (Letzte TZ)
With this entry you can immediately see when changes were last made to the respective land register body.

Property number (GST-NR)
A property is part of the property cadastre. Each property is assigned exactly one property number to make it identifiable.
Border cadastre (G)
The G between GST-NR and BA (Nutzung) stands for border cadastre. If there is a G next to a property number, then the property is in the border cadastre. This means that the property boundaries are legally binding and cannot be challenged by neighbors.
Use (BA)
BA shows how the property is used (e.g. building area, gardens).
Ground area
The respective ground area is shown for each property, which was either calculated or measured from a survey plan.

Rights, restrictions and burdens
The rights, restrictions and burdens associated with the property are listet on the A2 sheet of the land register. They are clearly marked with a consecutive number and the year, so that the document can be retrieved online or retrieved from the district court. Documents before 2003 can only be viewed in the district court. Documents after 2003 have generally been digitized and are available online.

Owner
There can be both exklusive owners and multiple owners. The shares (e.g. 1/1) show the ownership of the property.
Information about the owner
Under the name of the owner you can see when he was born and with which main residence address he is registered with the district court. As a rule, this data is current. In some cases it happens that the owner moves and forgets to report it to the district court.
Obtaining property rights
Under the date of birth or address line, a note is made as to how the owner acquired his or her ownership rights. A rough distinction must be made here between purchase (purchase agreement) and inheritance (responsibility decision).

Prohibition of encumbrances and sales
As the terms already suggest, the respective owner may neither burden the property (e.g. with a lien as security for a bank when granting a loan) nor sell it. This prohibition is usually imposed on the owner as part of a donation contract. For example, the donors want to be sure that the property stays in the family and is not sold. In order to delete this ban, the donor would have to submit a notarized declaration of waiver.
Right of first refusal
With a right of first refusal, a natural or legal person is granted the right to purchase property shares at the same price as the highest bidder upon sale. This person has 30 days to make a decision.
